By accessing and using the Xolimo website and services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our website or services.
Xolimo provides professional landscape design and property maintenance services, including but not limited to:
All quotations provided by Xolimo are valid for thirty (30) days from the date of issue unless otherwise specified. Quotations are based on site assessments and client specifications. Final pricing may be adjusted if site conditions differ from initial assessments or if client requirements change.
Service agreements must be confirmed in writing, either electronically or by signed contract. A deposit may be required before work commences, typically ranging from 25% to 50% of the total project cost.
Clients engaging Xolimo's services agree to:
Payment terms will be specified in individual service agreements. Generally, payment is due upon completion of services for smaller projects, while larger projects may require staged payments. We accept various payment methods including bank transfer, credit cards, and checks.
Late payments may incur interest charges at a rate of 1.5% per month or the maximum rate permitted by law, whichever is lower. Xolimo reserves the right to suspend services for accounts with outstanding balances exceeding thirty (30) days.
Clients may cancel or reschedule services with at least 48 hours' notice without penalty. Cancellations made with less than 48 hours' notice may incur a cancellation fee of up to 50% of the scheduled service cost. For contracted projects, cancellation terms will be specified in the individual service agreement.
Xolimo reserves the right to reschedule services due to inclement weather or other conditions that may compromise safety or service quality. We will make reasonable efforts to notify clients of weather-related delays and reschedule at the earliest opportunity. Neither party shall be liable for delays or failures in performance resulting from acts beyond reasonable control, including natural disasters, government actions, or other force majeure events.
Xolimo warrants that all services will be performed in a professional and workmanlike manner. We guarantee plant materials for a period of thirty (30) days from installation, provided that clients follow our recommended care instructions. This guarantee does not cover damage from severe weather, pests, disease, or improper care by the client.
For hardscaping and construction work, we provide a one-year warranty against defects in workmanship. This warranty does not cover normal wear and tear, damage from misuse, or issues arising from ground movement or settling.
Xolimo's liability for any claim arising from our services shall not exceed the total amount paid by the client for the specific service giving rise to the claim. We shall not be liable for indirect, incidental, consequential, or punitive damages arising from our services or any breach of these terms.
All landscape designs, plans, drawings, and creative materials produced by Xolimo remain our intellectual property unless explicitly transferred to the client in writing. Clients receive a license to use designs for the specific property for which they were created but may not reproduce or use designs for other properties without our written consent.
We are committed to protecting your privacy and personal information. All client data is handled in accordance with applicable data protection regulations. We collect only necessary information to provide our services and do not share client information with third parties except as required to deliver services or comply with legal obligations.
Xolimo reserves the right to modify these Terms and Conditions at any time. Changes will be posted on our website with an updated effective date. Continued use of our services after modifications constitutes acceptance of the revised terms.
These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of England and Wales.
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
